TOWN BOARD SCHEDULES PUBLIC HEARING ON DECEMBER 13TH -MORE EVIDENCE RE: MASSAGE ESTABLISHMENT

At the Town Board work session, just completed, the Board decided to reopen the proceedings related to the Forest Yin massage establishment appeal. During last night’s proceeding several evidentiary matters  were raised by both the applicants attorneys and the town police chief. In addition, several members of the public indicated that they had evidence for the Board to consider (they showed advertisements) that was not made a part of the record.

As a result, the Board members felt that we should schedule a public hearing on December 13th at 7:30 PM so we could gather more evidence at a formal public hearing. The comments made at last night’s public hearing will be incorporated into the record of the proceedings.

The Town Board recognizes the fact that we are acting in a quasi- judicial capacity.  We want to make sure that the record is accurate and complete.  We recognize that December 13th is around the holiday time but want to act quickly and make a decision soon.

 

The Town Board last night voted to add parking restrictions on Highridge Road between the intersection of Midvale Road  and westward for a distance of 350 feet. We also voted to add a stop restricton on the first street at the intersection of Saratogra Road and a stop restriction on Taxter Road at the intersection of Mountain Road and East Sunnyside Lane.  We welcome suggestions that could help make our community safer. And our police department reviews every concern.

This is a memo the police chief sent to some residents earlier today concerning action steps the town has taken regarding massage establishments in recent months….

 

A total of seven massage establishments either closed or were shut down after the enactment of our local law. This includes 4 establishments on Central Avenue in Edgemont, 2 establishments on Tarrytown Road in White Plains, and one on Central Avenue in Hartsdale (Dove Spa/Spa 114). Two establishments closed pre-emptively, and five were closed after submitting applications and being denied Massage Establishment Licenses. Violations were found at all five establishments during our background checks while their applications were pending.

 

Forest Yin Spa was in compliance with our local law during the application process, passed a background check and we (Police Department and Building Department) recommended that they be issued a Massage Establishment License. The Town Clerk issued their Massage Establishment license in March. This is the distinction between Forest Yin and the seven other establishments.

 

In July, our officers conducted an undercover investigation at Forest Yin Spa and found violations of state and local law. One individual was arrested and the process was started to close this establishment permanently.

 

The wheels of justice do not always turn as fast as we would like them to, but we ask for your patience during this process. We are committed to protecting the health, welfare and safety of our residents while following the law and protecting individual rights.
