Town Bd to discuss another RFP (request for proposals) for Frank's Nursery

If the town of Greenburgh sells the old Frank's nursery to Game On, an indoor sporting facility, their competitor The House of Sports will sue us.

If the town sells the old Frank's Nursery to House of Sports, an indoor sports facility, their competitor Game On has advised the town that they will also fight the sale in court.
The result: Litigation. And--delays. The contaminants on the property won't be cleaned up by the new owners.

One of the reasons for a lawsuit: there was never any formal RFP process for the sale of the property. In 2011 we issued an RFP for the property but at that time the Board was interested in pursuing a lease, not a sales arrangement.

I think that the Town Board should consider issuing another RFP -request for proposals for the sales of Frank's nursery. The Town Board will discuss this proposal Tuesday at 9:30 AM during our work session. If an RFP is issued the public will be able to compare the competing offers. And- the property should be sold to the bidder who submits the best proposal for the town.

If we issue another RFP we will be providing other developers who had not previously expressed interest in the property with an opportunity to bid to purchase the property. Who knows...the winning bid may be higher than the current proposals -and come from someone else. It's fair. Bids would be sealed and opened at a public forum. The town could set a minimum bid, require payment by a certain date. And limit the proposals for specific uses (such as recreation, residential) if we wish or encourage everyone who has an idea for the property to submit bids.

In the meantime, Game on announced that they have an option to purchase the Golf Range, located next to Frank's. They indicated to the Town Board that they are also interested in purchasing Frank's.
