County Court Judge Susan Cacace dismissed both Article 78 proceedings brought by Greenville and the CGCA challenging the Town Board’s issuance of a “Special Permit” on the ground that Petitioners were raising the same arguments in their action against the Town Board that were raised in a previously litigation against the ZBA challenging the issuance of “variances.”  The decision is attached.
