The Greenburgh Town Board approved the following resolution regarding the abandoned Westhelp homeless shelter. The Board wishes to convert the property to affordable rental housing.
We also awarded a contract for the repaving of various streets in the town of Greenburgh to Montesano Bros, Inc the lowest bidder for an amount not to exceed $5,088,208.30. The company we used last year went bankrupt and we had to re-bid the road repaving, delaying the start of the repaving season. It is anticipated that some of the roads scheduled to be repaved will be repaved in late September or October (probably in October)---with the balance of the 5 million+ repaving contract to be completed in the spring of 2016.

RESOLUTION OF THE TOWN BOARD AUTHORIZING THE TOWN SUPERVISOR TO ENTER INTO AN AGREEMENT WITH MARATHON DEVELOPMENT GROUP, LTD. TO REDEVELOP AND CONVERT 108 RENTAL HOUSING UNITS AT THE FORMER WESTHELP SITE AT ONE WESTHELP DRIVE TO 54 UNITS OF AFFORDABLE RENTAL HOUSING AND TO MANAGE THE UNITS FOR USE BY QUALIFIED FAMILIES FOR THE UNEXPIRED TERM OF THE TOWN’S GROUND LEASE WITH THE COUNTY OF WESTCHESTER

WHEREAS, the County is the owner of certain lands located adjacent to the Westchester Community College campus in the Town of Greenburgh, consisting of approximately six (6) acres of land; and

WHEREAS, on or about April 24, 1990, the County entered into a Ground Lease Agreement with WestHELP, a New York not-for-profit corporation, to construct a housing facility for the provision of emergency homeless and transitional housing and services to homeless persons for a ten (10) year term which expired on September 17, 2001 (“the WestHELP Lease"); and

WHEREAS, on or about April 26, 1990, the County entered into a Ground and Facilities Lease Agreement with the Town (the "Town Ground Lease"), pursuant to which it leased the Premises to the Town for a thirty (30) year term, commencing upon the expiration of the WestHELP Lease, for the purpose of providing housing to low and moderate income persons and families; and

WHEREAS, the WestHELP Lease with the County expired on September 17, 2001 and the term of the Town Ground Lease was deemed to have commenced on September 18, 2001; and

WHEREAS, on or about on September 18, 2001, pursuant to a request from the County, the Town agreed to modify the Town Ground Lease to permit use of the Premises by WestHELP as an emergency homeless housing facility for an additional ten (10) year term pursuant to a Sublease and Homeless Housing Facilities Agreement (the “WestHELP Sublease”) dated September 18, 2001 by and between the Town, WestHELP and the County; and

WHEREAS, the Town was only willing to forego occupancy under the Town Ground Lease and to permit the County and WestHELP to continue to use the Premises for the provision of housing and services to homeless families pursuant to the WestHELP Sublease if the Town was able to continue to use the Premises for low and moderate income persons and families, commencing upon the expiration of the WestHELP Sublease; and

WHEREAS, the WestHELP Sublease expired on September 30, 2011 and the Town has been aggressively trying to gain approvals for the continued use of the property during the remainder of the term of the Ground Lease;

NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Greenburgh hereby authorizes the Town Supervisor to enter into an agreement with Marathon Development Group, LTD. to redevelop and convert 108 rental housing units at the former Westhelp site at One WestHELP Drive to 54 studio and one and two bedroom units of affordable rental housing and to manage the units for use by qualified families for the unexpired approximately 15 year term of the Town’s Ground Lease with the County of Westchester.
